BOOKING TERMS:
GENERAL BOOKING:
1. For some services listed on the website or announced by the administrator during booking, a prepayment of 50% of the service cost is required to reserve the time slot.
2. Payment must be made within 2 days from the moment of booking by the client, otherwise the reservation will be considered invalid.
3. In case of cancellation by the client, regardless of the reason, less than 24 hours before the appointment, or interruption of the service, the prepayment of 50% of the service cost is NON-refundable. In this case, the booking is cancelled.
4. In case of cancellation by the client, regardless of the reason, more than 24 hours in advance, the prepayment of 50% of the service cost is NON-refundable and is credited to a deposit account for up to 3 months, and/or upon the client's request, the booking date may be rescheduled for up to 3 months.
BOOKING WITH A GIFT CERTIFICATE:
1. In case of cancellation of an appointment made with a gift certificate by the client, regardless of the reason, less than 24 hours before the appointment, the certificate is annulled.
2. In case of cancellation by the client, regardless of the reason, more than 24 hours in advance, the appointment date can be rescheduled once within the validity period of the certificate.
USER AGREEMENT (PUBLIC OFFER):
1. Terms and Definitions
1.1. Public Offer – an offer by the Service Provider addressed to any individual (hereinafter referred to as the "Client" or "User" or "Customer") in accordance with Article 633 of the Civil Code of Ukraine to conclude an Agreement under the terms stated in the Public Offer (hereinafter – Public Offer or Agreement).
1.2. Agreement – a service agreement for booking the rental time of the SPA complex or massage, provided by the Service Provider under the terms of the Public Offer at the moment of acceptance by the User (hereinafter – Agreement).
1.3. Services – services for booking the rental time of the SPA complex or massage provided by the Service Provider to the User.
1.4. Website – the online resource located at: https://kievmas.com.ua/
1.5. Account – a set of User data required for authentication.
1.6. User – an individual over 18 years of age, with full legal capacity, who has concluded an Agreement with the Service Provider under the terms stated in the Public Offer by acceptance.
1.7. Service Provider – Individual Entrepreneur Yevhenii Serhiiovych Shcherbyna, providing services for booking rental of the SPA complex or massage under the terms stated in the Public Offer.
1.8. Acceptance – full and unconditional agreement of the User with the terms of the Public Offer.
1.9. Cancellation – the Customer's refusal of the booked services.
1.10. Booking date and time – the date and time of the guest's arrival at the salon.
1.11. Late cancellation – the Customer's refusal of the ordered services less than 1 (one) calendar day in advance. No-show – the actual failure of the Customer to appear on the day of the appointment or cancellation of services less than 24 hours before the agreed date.
1.13. Penalties – a fine paid by a Party in case of violation of the terms of this Agreement.
2. Subject of the Agreement
2.1. The Service Provider offers to conclude an Agreement for the provision of services for booking the rental time of the SPA complex or massage, as specified in this Agreement. The services are provided at the address: Ukraine, Kyiv, Prorizna St., 18/1-H.
2.2. By registering on the Website or booking by phone, the User accepts this Agreement, fully and unconditionally agrees to the terms of the services provided under this Public Offer, as well as the obligations imposed on the User, and undertakes to comply with them.
2.3. The User’s acceptance of this Public Offer may also be evidenced by the payment for the Services using one of the methods specified in this Public Offer.
3. User Registration
3.1. To book the services of the Service Provider for renting the SPA complex or massage, the User must register on the Website or call the salon administrator.
3.2. The User Agreement comes into effect once the User agrees to the terms by clicking the "I accept the User Agreement" button located in the registration form.
3.3. By filling out the registration authentication form or booking by phone, the User agrees to provide accurate and truthful information. If the User provides false information, the Service Provider has the right to deny such a User access to the SPA complex or massage services, including booking.
3.4. The User confirms at the time of registration or booking that they are at least 18 years old and have full legal capacity.
3.5. If the Service Provider suspects the User of engaging in unlawful activities, including: credit card fraud, spam distribution, malicious software, or other violations of this Public Offer, the Service Provider has the right to report such actions to the relevant authorities and/or block and/or delete the User’s account.
3.6. Lack of knowledge of the Ukrainian or English language does not release the User from the obligations under this Agreement. By registering on the Website or booking by phone, the User confirms that they are fluent in Ukrainian and/or English, and therefore states that this Public Offer cannot be considered invalid or unaccepted by the User solely on the basis that it is written in Ukrainian or English.
4. Intellectual Property
4.1. Any use of the results of intellectual activity published on the Website (including visual design elements, logos, texts, graphic images, illustrations, photos, videos, software, music, trademarks, and other objects) without written permission from the Service Provider or the legal copyright holder is illegal and may result in legal proceedings and the violator being held civilly, administratively, or criminally liable in accordance with the law.
4.2. Except as provided in this Public Offer or by applicable law, no intellectual property result may be copied (reproduced), modified, distributed, displayed in a frame, published, downloaded, transferred, sold, or otherwise used in whole or in part without the prior written consent of the Service Provider or the legal copyright holder.
5. Legal Status of the User
5.1. The User has the right to:
5.1.1. use the booking services provided by the Service Provider in the manner established by the Agreement;
5.1.2. other rights granted to the User under this Public Offer and the Law.
5.2. The User undertakes to:
5.2.1. comply with the provisions of the applicable Law, the Agreement, and other special documents of the Service Provider;
5.2.2. pay for the Services in the amount and manner specified in this Agreement;
5.2.3. regularly check the information posted on the Website, including this Public Offer, in order to stay informed about any changes and/or additions to the list of services provided by the Service Provider and their cost;
5.2.4. refrain from actions that interfere with the Service Provider’s operations, as well as from any other actions that violate the rights of the Service Provider and/or third parties;
5.2.5. not reproduce, duplicate, copy, sell, resell, or otherwise use the Website or any of its content for commercial purposes without the consent of the Service Provider;
5.2.6. provide accurate, current, and complete information about themselves when booking;
5.2.7. properly fulfill other obligations provided for by this Public Offer.
6. Legal Status of the Service Provider
6.1. The Service Provider has the right to:
6.1.1. send Users messages related to the promotion of the Service Provider’s services;
6.1.2. at its sole discretion, delete any information that violates and/or may violate the Law, the terms of the Agreement, or the rights of third parties; 6.1.3. make changes and/or additions to this Public Offer without special notification to the User. Such changes/additions shall take effect from the moment they are posted (published) on the Website unless otherwise specified by the Service Provider;
6.1.4. at any time request the User to confirm the data provided during registration and to provide a supporting document. Failure to provide such documents may be regarded as provision of false information, in which case the Service Provider has the right to deny the User registration or service access;
6.1.5. carry out marketing activities, including sending relevant information to the User’s email address and/or via SMS messages;
6.1.6. exercise other rights granted to the Service Provider under this Public Offer.
6.2. The Service Provider undertakes to:
6.2.1. accept and process registration forms or phone calls from Users;
6.2.2. accept payments for the Service Provider’s services;
6.2.3. fulfill other obligations of the Service Provider provided for in this Public Offer.
7. Payment for Services
7.1. The Service Provider offers services to the User on the condition of prepayment. Payment must be made within 2 days from the moment of booking, in the amount of 50% of the total cost of the services according to the current rates.
7.2. Payment for the Services is made by the User through one of the payment systems and methods supported by the Service Provider. The list of available payment systems and methods is determined by the Service Provider at its sole discretion and is published on the Website.
7.3. The Parties agree that in the event of a late cancellation (less than 24 hours before the appointment), a no-show, or interruption of the service by the client for any reason, the prepayment of 50% of the Service cost is NON-REFUNDABLE and will be retained by the Service Provider as a penalty for breach of the Agreement. In this case, the booking will be canceled.
7.4. The Parties agree that if the cancellation is made more than 24 hours in advance, the 50% prepayment is NON-REFUNDABLE but will be credited to a deposit account valid for up to 3 months, and/or the appointment date may be rescheduled for a period of up to 3 months at the Customer's request.
7.5. The User’s registration on the Website, booking by phone, and/or payment for services using any method listed on the Website constitutes grounds for the Service Provider and the User to obtain rights and obligations under this Agreement.
8. Liability
8.1. The User is responsible for the accuracy and reliability of the information provided when booking a Service.
8.2. The User is responsible for their own actions related to the creation and posting of comments on the Website in accordance with applicable law.
8.3. If third parties present claims against the Service Provider related to the User’s actions on the Website, the User agrees to independently resolve such claims at their own expense, protecting the Service Provider from any proceedings, losses, or compensation payments.
8.4. If such third-party claims result in the Service Provider incurring losses and/or the Service Provider pays any fines, compensations, damages, or expenses to such third parties, the Service Provider has the right to demand reimbursement, and the User agrees to fully reimburse the Service Provider for all such payments (fines, compensations, damages, expenses, etc.).
9. Limitation of Liability
9.1. Disclaimer for actions of the User or third parties. The Service Provider is not liable for:
9.1.1. any actions of the User;
9.1.2. the accuracy and correctness of the information provided by the User during booking;
9.1.3. any errors, omissions, interruptions, deletions, defects, delays in processing or data transmission, theft, destruction, or unauthorized access by third parties to intellectual property published on the Website;
9.1.4. incomplete, inaccurate, or incorrect entry of the User’s personal data during booking;
9.1.5. the User’s lack of Internet access and the quality of service provided by Internet providers or banking institutions.
9.2. In any case, the Service Provider’s liability to the User is limited to the amount not exceeding the total payments received from the User up to the time the event causing liability occurred.
10. Dispute Resolution
10.1. All disputes arising from this Agreement shall be resolved by the parties through negotiation.
10.2. Any claims from the User related to this Agreement must be submitted to the Service Provider by email at: salonmeliors@gmail.com
10.3. The Service Provider will, whenever possible, respond to the User’s claim via the email address provided by the User.
10.4. The Service Provider does not consider anonymous claims or claims that do not allow for User identification based on the data provided at registration.
11. Final Provisions
11.1. This Public Offer and all relations between the Service Provider and the User arising from this Public Offer shall be governed and interpreted in accordance with the applicable Legislation.
11.2. If, for any reason, any provision of this Public Offer is held to be invalid or unenforceable, this shall not affect the validity or enforceability of the remaining provisions.
11.3. This Public Offer is concluded for an indefinite period and applies to all Users who make a booking at the Meliors salon.
11.4. This Public Offer comes into effect from the moment it is published on the Service Provider’s Website.
